1. eProConst

The Constitutional Court's electronic platform, “eProConst”, allows you to file procedural documents, such as applications and briefs, electronically. Once a document has been filed electronically, it no longer needs to be sent by registered letter. Supporting documents can also be submitted via eProConst.

You can access eProConst via the federal authentication platform CSAM, using your electronic identity card (eID), the MyGov.be app or any other digital identification method of your choice.

The Registry continues to send all notifications by registered letter. You will therefore not receive any messages from the Registry through the electronic platform. However, you will receive an automatically generated email confirming each document you file.

3. FAQ

What technical requirements must documents meet?
All documents must be in PDF format, free of viruses and, where possible, copyable. All documents uploaded to eProConst are automatically subject to a technical check.
Is the use of eProConst mandatory?
No. The use of eProConst is not mandatory. You may still send your procedural documents by registered letter. However, once you choose to submit a procedural document in a particular case via eProConst, you must also submit all (subsequent) procedural documents in that specific case electronically. You may no longer send procedural documents regarding that case by registered mail.
Will I receive notifications from the Registry via eProConst?
No. The Registry continues to send all notifications by registered letter. At present, the Court’s Registry does not upload any documents to the electronic platform.
Will I receive confirmation of my submission?
Yes. You will receive an automatically generated email confirming each submission. At present, the email may indicate you have submitted “an application”, even if you have actually filed a brief or another procedural document. This is neither a phishing email nor a bug, but the result of incorrect wording in the automated reply message, which we are working to correct as soon as possible. This issue does not affect the operation of the platform as such or the validity of the electronic submissions.
What should I do if I encounter technical problems?
If you encounter technical problems while using eProConst, please report them to the Registry. eProConst currently has a few minor technical issues, particularly regarding the display of the name and capacity of the submitting party or parties. We are working to resolve these issues as soon as possible. They do not affect the operation of the platform as such or the validity of the electronic submissions.
Do the current technical issues affect the validity of submissions?
No. The technical issues currently known do not affect the operation of the platform as such or the validity of the electronic submissions.

4. Regulations

Article 78bis of the Special Act of 6 January 1989 on the Constitutional Court provides the legal basis for eProConst.

That provision is implemented by the Royal Decree of 12 September 2024 “on electronic proceedings before the Constitutional Court”.

The use of eProConst is governed by the general terms and conditions of use of eProConst, which set out the conditions and detailed rules governing the electronic platform. They are available in Dutch and French.

When maintenance work and/or periods of unavailability of eProConst are scheduled, you will be informed in good time on this page.

There are currently no planned maintenance operations and/or periods of unavailability of eProConst.

In addition, the automated submission confirmation email refers to an application, even if you have filed a brief or another procedural document. The Court is aware of these issues and is taking the necessary steps to resolve them as soon as possible. They do not affect the operation of the platform as such or the validity of the electronic submissions.
